ALAMCCO/ KAPA - Nakakatulong nga ba o Nakakakaba?

Maraming pilipino na ang nahihikayat sa ganitong uri ng Investment Scheme dahil sa ipinapangakong interest per month out of capital na umaabot sa 30% (KAPA) - 35% (ALAMCCO) . Gaano nga ba katotoo ang Investment Scheme na ito?
Iilan ay hindi pa rin kumbensido sa ganitong uri ng Easy money dahil sa mga nangyaring Investment Scheme din noon na hindi naman naging matagumpay pero may iilan o nakararami pa rin ang nahihikayat dahil sa mga taong nakakatanggap na. Sabi nga ng iilan, kung ikaw ay pumasok sa isang ganitong investment scheme dapat ay nakahanda ka, matatag ang loob mo at kailangan marunong kang sumugal dahil hindi mo alam ang mga susunod na mangyayari maliban sa hinahangad mong makaahon sa hirap sa madaliang paraan.

Ang Security and Exchange Commission sa Pilipinas ay nagpalabas ng isang paalala sa mga myembro, hindi pa myembro o magpapamyembro pa lang ng Alamcco/ Kapa.

SEC ADVISORY
 The public is hereby warned concerning the investment taking activities of ALMAMICO/ALAMCCO.
AMICO/ALAMCCO is enticing the public to become their member through an investment opportunity.  The scheme is to offer 35% interest per month of the invested money,  a promised interest rate that is too high to sustain their claims that every member will receive as long as the cooperative operates.
Per verification, ALMAMICO (Alabel-Maasim Small Scale Mining Cooperative)/ALAMCCO (Alabel-Maasim Credit Cooperative) is NEITHER registered as a corporation NOR as a partnership.  Thus, NOT being registered with this Commission as a corporation nor as a partnership, it is with more reason that they are NOT allowed to offer, solicit, sell or distribute any investment/securities from the public as the same requires a secondary license for such activity.
As we always keep on reminding the public, such investment opportunities are in the nature of investment contracts, which in turn are considered as securities subject to the regulatory authority of this Commission.  The offering or sale of securities to the public without a permit or license from the Commission is a violation of Section 8.1 of the Securities Regulation Code (SRC).
We REITERATE that, those who act as salesman, brokers, dealers or agents of ALMAMICO/ALAMCCO in selling or convincing people to invest in the investment scheme being offered by ALMAMICO /ALAMCCO including solicitation or recruitment through the internet may likewise be prosecuted and held criminally liable under Section 28 of the Securities Regulation Code (SRC) and penalized with a maximum fine of Five Million pesos (P5,000,000.00) or penalty of Twenty One (21) years imprisonment or both pursuant to Section 73 of the SRC.
Accordingly, those who invite or recruit other people to join or invest in this venture or offer contracts or securities to the public may be held liable or accordingly sanctioned or penalized in accordance with the Supreme Court decision in the case of SEC vs. Oudine Santos (G.R. No. 195542, March 19, 2014).
In view thereof, the public is hereby advised to exercise caution before investing in these kinds of activities and to take the necessary precaution in dealing with ALMAMICO/ALAMCCO or its representatives.

            The Commission has received information that an entity named KAPA COMMUNITY MINISTRY INTERNATIONAL, INC., is operating in Mindanao particularly in Pangyan Glan and Alabel, Sarangani Province, Bislig City, Surigao del Sur, General Santos City, South Cotabato offering insurance to the public to invest in their company with a promise that the people can get a 30% interest income at the end of the month.
The public is hereby informed that KAPA COMMUNITY MINISTRY INTERNATIONAL, INC.,  is registered with the Commission as a non-stock corporation under SEC Registration No. CN 201707724 on 03 March 2017 with office address located at Garay Arcade, Barreda Street, Caramcam District, Bislig City, Surigao del Sur 8311.  The following are the directors and officers of said corporation, namely: (1) Ptr. Joel A. Apolinario; (2) Nonita S. Urbano; (3) Junnie G. Apolinario; (4) Nelia V. Nino; (5) Maria Pella B. Sevilla; (6) Jouelyn A. del Castillo; (7) Cristobal R. Barabad; and (8) Joji A. Jusay.  Based on the records of the Commission, it is not authorized to solicit investment which require a secondary license as provided under Sec. 8.1 of the Securities Regulation Code (SRC).
That a certain GROUP being represented by a certain Pastor Jun Apolinario and/or Joel Apolinario is enticing the public to invest with a promise of 30% interest every month until forever in the guise and/or scheme of a “Deed of Donation” or “Certificate of Membership” enticing the public to invest with promise of 30% interest every month until forever.
Section 28 of the Securities Regulation Code (SRC) prohibits any person from engaging in the buying or selling of securities in the Philippines as a broker, dealer, salesman, or associated person of a broker or dealer unless registered as such with the Commission.
Accordingly, those who invite or recruit other people to join or invest in this venture or offer investment contracts or securities to the public may be held criminally liable or accordingly sanctioned or penalized, in accordance with the Supreme Court decision in the case of SEC vs. Oudine Santos (G. R. No. 195542, March 19, 2014).
In view thereof, the public is advised to STOP INVESTING in this kind of investment activity and to take the necessary precautions in dealing with the above-named entity and/or its representatives.

For further reference, on 08 March 2017,  the Commission issued an ADVISORY on KAPPA (KABUS PADATOON)  founded by a certain MR. JOEL APOLINARIO collecting investments with a promise that 30% of one’s investment will be paid back every month until forever.  The public was advised to STOP INVESTING in these kinds of investment activities and to take the necessary precaution in dealing with the said entity and/or its representatives which can be viewed at the Commission’s website at www.sec.gov.ph.
